On December 3, 2024, Rep. Kustoff criticized President Joe Biden's decision to pardon his son, stating that it was made for familial rather than national interests. "Joe Biden made the decision to pardon his son for the good of his own family, not for the good of the nation. That is wrong." He encouraged viewers to watch his interview on Newsmax.
The following day, December 4, 2024, he addressed the issue of "swatting," describing it as a false crime report intended to provoke a law enforcement response at a specific location. "Swatting is when a crime is falsely reported to emergency services with the intent to draw a law enforcement presence to a particular location." He noted that elected officials and Trump cabinet nominees were recently targeted by such incidents.
Later on December 4, Rep. Kustoff met with members of the Tennessee General Assembly and Secretary of State Tre Hargett before hearings in U.S. v. Skrmetti took place.
